Williams Case Declared the Most Significant False Claims Act decision of 2012
In an article published in the January 13, 2013 edition of The Government Contractor, the decision of the Sixth Circuit in U.S. ex rel. Williams v. Renal Care Group was identified as the most significant False Claims Act legal decision of 2012. The Sixth Circuit’s decision was noted for its holding that a defendant lacks the intent required to violate the FCA when it follows industry practice and publications, follows advice of counsel, and attempts to obtain assistance from the proper government agency.
