U.S. District Court for the District of Massachusetts dismisses case

On May 11, 2018, the United States District Court for the District of Massachusetts dismissed all claims in Kaplan et al. v. Fulton Street Brewery, LLC, a putative class action lawsuit involving a dispute about the flavor of beer produced by a Dowd Bennett client.  The plaintiffs sought to represent a nationwide class of beer drinkers and asserted claims for alleged violations of consumer protection laws, breach of warranty of merchantability, and unjust enrichment.  The court held that the plaintiffs’ claims were mooted when a full refund was tendered to them.
