First Circuit Court of Appeals Affirms District of Massachusetts Verdict
After a unanimous jury returned a verdict in favor of Dowd Bennett client Fresenius Medical Care in August of 2012, the government appealed the case to the United States Court of Appeals for the First Circuit.
The First Circuit heard oral argument and ultimately decided that the District of Massachusetts handled the case properly and affirmed the original verdict. This meant that the government would in fact have to issue tax refunds to Fresenius Medical Care which, with accumulated interest factored in, totals more than $50,000,000. The case was handled by Jim Bennett and Megan Heinsz.
