Missouri Circuit Court Denies Motion to Stay Arbitration in Favor of Dowd Bennett Client
On February 23, 2021, the Missouri Circuit Court for the Twenty-Second Judicial Circuit denied an Emergency Motion to Stay Arbitration Proceedings in TMEMA Associates DE LLC et al. v YDC Inc. d/b/a Rezi et al. The Plaintiffs sought to stay arbitration proceedings that were pending in New York by relying on Missouri Revised Statute Section 435.355.2. However, following oral argument, the Court denied the Motion to Stay by holding “the Court lacks jurisdiction to stay the subject arbitration proceedings currently pending in the state of New York” and “the underlying arbitration agreement delegates this issue to the arbitrator.” Ed Dowd and Arsenio Mims of Dowd Bennett represented Rezi, the Defendant in the case.
