Dowd Bennett Wins Summary Judgment for Employer in Americans with Disabilities Act Case
Dowd Bennett successfully defended a retail employer in a case filed under the Americans with Disabilities Act. After partially granting Dowd Bennett’s motion to dismiss and dismissing all state claims against the employer, the U.S. District Court for the Western District of Missouri later granted summary judgment to the employer on October 21, 2009. The court concluded that the action taken by the employer was not as a result of a disability of the Plaintiff and further concluded that the undisputed, material evidence demonstrated that Plaintiff was not disabled, as defined by the ADA.
