Opinion Judgment Filed in Favor of Dowd Bennett client Renal Care Group, Inc.
On October 5, 2012, the United States Court of Appeals for the Sixth Circuit rendered a judgment in favor of Dowd Bennett client Renal Care Group, Inc., in a widely-watched False Claims Act case. The decision reversed an $82.6 million judgment against Renal Care Group and remanded for entry of judgment on two False Claims Act counts in favor of the defendants. The remainder of the counts were remanded for further proceedings. The decision has been reported by the Bureau of National Affairs, Forbes, the American Health Lawyers Associations and others and has been described by commentators (here, the Fried Frank law firm in a client alert) as a “much-needed common sense approach” to the FCA and as “important and refreshing for a number of reasons.” A link to the decision can be found below.
